END-USER LICENCE AGREEMENT

PLEASE READ THESE LICENCE TERMS (THE “TERMS”) CAREFULLY BEFORE USING THIS APP

These Terms (together with the Privacy Policy /privacy-policy and any other documents referred to in it) tells you the terms of use on which you may make use of our mobile application Bet Blocks (the “App”). Please read these Terms carefully before you start to use the App. By using the App, you indicate that you accept these Terms  and that you agree to abide by them. If you do not agree to these Terms, please refrain from using the App.

Bet Blocks is an App operated by Bettor Faster Ltd (“Bettor Faster”, “We”, “Us”). Bettor Faster is registered in England with company number 10280624 and our registered office is at 51, 3 Atkins Square Dalston Lane, London, E8 1FP.

These Terms also include Bettor Faster Privacy Policy which sets out the terms on which Bettor Faster processes any personal data collected from you, or that you provide to Us. By using the App, you consent to such processing and you warrant that all data provided by you is accurate.

The App

The App provides you with a platform which facilitates:

(i) browsing betting events and related odds from selected gambling operators (“Third Party Operators”) via the Cyan Blue Odds Limited (a company registered in Alderney with registered company number 1919 and registered office at Century House, 12 Victoria Street, Alderney GY9 3UF) (“Oddschecker”) API;

(ii) placing bets with the Third Party Operators via the Oddscheker API;

(iii) sharing bets and sending instant messages to other registered users;

The services in (i) to (iii) above, together with any other service made available by the App at any time, constitute the “Services”.

For the avoidance of doubt the processes for placing bets, making payments, requesting and receiving money and any other service made available via a Third Party Operator are subject to that Third Party Operator terms and conditions. Accordingly, this may include the right of the Third Party Operator to refuse a bet or to void a bet or part of a bet in accordance with its terms and conditions.

The Third Party Operators’ terms and conditions are made available to you at the point of placing the bet.

Licence

Bettor Faster grants you a non-exclusive non-transferable licence to use the App and the Services in accordance with these Terms.

You shall not:

  • rent, lease, sub-license, loan, provide, or otherwise make available, the App or the Services in any form, in whole or in part to any person without prior written consent from us;
  • not translate, merge, adapt, vary, alter or modify, the whole or any part of the App or Services nor permit the App or the Services or any part of them to be combined with, or become incorporated in, any other programs.
  • copy, reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the App, any updates, or any part thereof (except as and only to the extent that any foregoing restriction is prohibited by law).

Use of the App

Use of the App is subject to:

  • You opening an account with the App;
  • You being resident in the UK; and
  • You being at least 18 years old of age.

We reserve the right to refuse to open an account for any reason. You acknowledge and agree that when you are accessing and retrieving information from Third Party Operators or Oddschecker APIs using the App, we are not acting as your agents nor the agents on behalf of the Third Party Operators but that we are simply making available the App and Services to you by which you may access and transact with such Third Party Bookmakers via the Oddschecker API.

You agree not to use the App and/or the Services to harass, abuse, stalk, threaten or defame any person or entity, and that Bettor Faster is not responsible for any such use.

Bettor Faster reserves the right to change, suspend, remove, disable or impose access restrictions or limits on the Services or any Third Party Bookmakers at any time without notice or liability to you.

We may suspend or withdraw or restrict the availability of all or any part of the App for business and operational reasons.

Intellectual Property Rights

Bettor Faster is the owner or the licensee of all intellectual property rights in the  App, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

Warranty

The App is provided “as is”.

Bettor Faster does not warrant that your use of the App and/or Services will be uninterrupted or error-free. Bettor Faster does not guarantee the accuracy and availability of any content shown on the App.

Any warranty, condition or guarantee whatsoever, express or implied (including, without limitation, any implied warranty of accuracy, completeness, uninterrupted provision, quality, merchantability, fitness for a particular purpose or non-infringement) are excluded to the fullest extent permitted by law.

Liability

Bettor Faster shall not be liable for any injury, loss, claim, loss of data, income, profit or opportunity, loss or damage to property, general damages or any direct, indirect, special, incidental, consequential, exemplary or punitive damages of any kind whatsoever arising out of or in connection with your access to, or use of, or inability to use, our products and services, any software, any materials or other information on the App.

You specifically acknowledge, agree and accept that we are not liable to you for:-

  • any loss whatsoever arising from the use, abuse or misuse of the App;
  • any loss incurred in transmitting information by the internet or by e-mail;
  • any incorrect bets being placed;
  • technical faults with Third Party Operators or Oddschecker;
  • any technical failures, system breakdowns, defects, delays, interruptions, manipulated or improper data transmission, loss or corruption of data;
  • communications’ lines failure or distributed denial of service;
  • attacks, viruses or any other adverse technological consequence of your choosing to use the App;
  • the accuracy, completeness or currency of any information, services  and data provided; and
  • any failure on our part to interact with you where we may have concerns about your activities.

Bettor Faster does not exclude liability for fraudulent misrepresentation or death or personal injury caused by negligence.

Bettor Faster shall not be liable for any services or contents provided by Oddschecker or The Third Party Operators, including, but not limited to, in relation to the placing of bets, the deposit of money and the payment of winnings as these are services provided by the Third Party Operators and/or Oddschecker and are subject to these parties terms and conditions.

Termination

These Terms are effective until terminated by you or Bettor Faster. Your rights under these Terms will terminate automatically if you fail to comply with any of its terms.

Waiver

No waiver by Bettor Faster of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Bettor Faster to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

Severability

In the event that any or any part of the terms contained in these Terms shall be determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term shall to that extent be severed from the remaining terms which shall continue to be valid and enforceable to the fullest extent permitted by law.

Variation

We may amend these terms at any time by amending this page without notification. Every time you wish to use our App, please check these terms to ensure you understand the terms that apply at that time.

Jurisdiction

These Terms and the Service are governed by English law and subject to the exclusive jurisdiction of English courts.
